Marilyn Manson has secured victory as a sex assault lawsuit brought by his former assistant was dismissed by a judge just one month before a scheduled trial.
Ashley Walters, who previously worked with Manson between 2010 and 2011, filed a lawsuit in May 2021 in Los Angeles alleging that she suffered “terrifying” abuse at the hands of the star.
Walters said Manson abused her sexually, physically and psychologically during her brief career but has “repressed” the memory until 2020.
Manson has consistently denied Walters’ allegations and has repeatedly tried to have the case dismissed as his attorneys argue that the case violates California’s two-year statute of limitations.
The case was initially dismissed in May 2022 but revived in December 2023 on appeal.
According to Rock-cutIn a recent court hearing on Tuesday, Los Angeles County District Judge Steve Cochran dismissed Walters’ lawsuit for the second time, ruling that it fell outside the statute of limitations.
Judge Cochran said, “We have a situation where the complaint was not filed until 10 years after the events of the operation. I am unable to find that the statute of limitations is applicable.”
“I have no authority to rule whether the late discovery doctrine would apply under the circumstances of this case,” he added.
Meanwhile, Marilyn Manson’s lawyer Howard King celebrated the dismissal in a statement Daily Mailsaying, “It’s nice, after all these years, that a judge can just look at the facts and see that once again, Brian Warner was wrongly accused. It’s good for him to get justice, even though it was at a personal cost. Now he can move on.”
